Terms of Service

These terms are an agreement between your business and QRwik, a sole proprietorship of Md Rehan Ansari (“QRwik”, “we”). By creating a QRwik account or using QRwik you accept them. Please also read our Privacy Policy. If you are a customer visiting a shop’s QRwik page, the shop is responsible for its products, prices and service; sections 7 and 13 also apply to you.

1. Agreement

“You” means the business (and the person accepting for it) that opens a QRwik account. The person accepting confirms they are at least 18 and authorised to bind the business.

2. The service

QRwik lets a shop publish its catalogue, menu, price list or packages behind a QR code; take orders, bookings and enquiries; collect reviews and feedback; run offers, coupons and a loyalty club; and send messages to its customers by WhatsApp and email — all managed from the QRwik dashboard. Features depend on the plan chosen.

3. Accounts

  • Give accurate details and keep them up to date.
  • Keep your password private. You are responsible for everything done through your account and your staff’s accounts.
  • Tell us at once at support@qrwik.com if you suspect someone has accessed your account without permission.
  • We may review new shops before activating them, and may refuse an account for a lawful reason.

4. Plans, fees and payment

  • Plan prices, renewal fees and what each plan includes are shown on our website and at sign-up. Prices are in the currency of your country and taxes (such as GST) are added where applicable.
  • Fees are paid in advance. A plan renews for the period shown unless you cancel before the renewal date. If a renewal is not paid, we may limit or pause the shop until it is.
  • Setup fees cover work we do to set up your shop and are non-refundable once that work has started, except where the law requires a refund. If something goes wrong, write to us — we will review every request fairly.
  • We may change prices for future periods; we will tell you at least 30 days before a change affects you.
  • Meta’s WhatsApp charges are separate. Messages sent through the WhatsApp Business Platform are charged by Meta, under Meta’s pricing, to the payment method you add in your own Meta account. QRwik does not collect, hold or add a margin to these charges.

5. WhatsApp and Meta services

  • You may connect your own WhatsApp Business account to QRwik by signing in with Facebook through Meta’s Embedded Signup. The WhatsApp Business Account and phone number belong to you, and you accept Meta’s terms for them, including the WhatsApp Business Terms of Service, the WhatsApp Business Messaging Policy and the WhatsApp Commerce Policy.
  • You authorise QRwik to send messages, manage templates and read account information for that account on your behalf. You can remove this access at any time from QRwik or from your Meta business settings.
  • Before sending any marketing message you must have the customer’s clear permission (opt-in) to receive messages from your business on WhatsApp, and you must stop messaging anyone who asks you to.
  • Do not send spam, misleading content, or anything WhatsApp’s policies forbid, and do not message people who have not agreed.
  • Meta decides template approval, messaging limits, quality ratings and pricing, and may restrict or suspend a WhatsApp number at its discretion. QRwik is not responsible for Meta’s decisions, but we will help you understand and fix the cause where we can.
  • If your use of WhatsApp puts QRwik’s access to Meta’s platform at risk, we may pause messaging for your shop.

6. Your customers’ data

For the personal data of your customers, you are the data fiduciary and QRwik processes it on your behalf to provide the service. You must:

  • collect it lawfully and tell your customers how you use it;
  • have their consent where the law requires it, including before sending marketing messages;
  • import only contacts you are allowed to message;
  • act on your customers’ requests to access, correct or delete their data — we will help you do this.

We will process your customers’ data only to provide QRwik to you, keep it secure, and handle it as described in our Privacy Policy.

7. Acceptable use

You and anyone using a QRwik page must not:

  • sell or promote illegal, counterfeit, or restricted goods or services, or anything WhatsApp’s Commerce Policy forbids;
  • post false, misleading, hateful, obscene or infringing content, or fake reviews;
  • collect people’s data without permission, or upload sensitive data such as health or financial account details;
  • try to break, overload, scrape or get around the security of QRwik, or access another shop’s data;
  • use QRwik to harass anyone or send unwanted messages.

8. Your content and our rights

You own the content you add — your logo, photos, product details and messages. You give QRwik a limited licence to host, show and send it as needed to run the service for you. You confirm you have the rights to it. QRwik, its software, design and brand belong to us; you may not copy or resell them.

9. AI features

AI features generate suggestions and replies automatically and can be inaccurate. Check AI-generated content before you publish or send it; you are responsible for what goes out in your shop’s name.

10. Third-party services

QRwik works with services we do not control, such as WhatsApp, Google reviews and customers’ UPI apps. Their own terms apply to your use of them, and we are not responsible for their availability or actions.

11. Availability and changes

We work to keep QRwik available and secure, but there may be interruptions for maintenance or for reasons outside our control. We may improve or change features; if we remove a feature that is central to your paid plan, we will tell you in advance.

12. Suspension and termination

  • You can stop using QRwik and ask us to close your account at any time.
  • We may suspend or close an account that breaks these terms, the law, or Meta’s policies, or that puts other users at risk. Where reasonable we will warn you first and give you a chance to fix the problem.
  • After closure you can ask for a copy of your data within 30 days; we then delete it as described on our Data Deletion page.

13. Disclaimers

QRwik is provided “as is”. Each shop is solely responsible for its products, prices, bookings, offers and service to its customers. To the extent the law allows, we do not promise that QRwik will be uninterrupted or error-free, or that it will produce a particular business result.

14. Limitation of liability

To the extent the law allows, QRwik is not liable for indirect or consequential losses, such as lost profits, lost data or business interruption. Our total liability for any claim is limited to the fees you paid QRwik in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

15. Indemnity

You will compensate QRwik for losses and costs arising from your content, your messages to customers, your breach of these terms or of Meta’s policies, or your breach of the law.

16. Governing law and disputes

These terms are governed by the laws of India. We will first try to resolve any dispute by talking to you. Otherwise, the courts at Ranchi, Jharkhand have exclusive jurisdiction.

17. Changes to these terms

We may update these terms. We will show the new date at the top and, for significant changes, tell you by email or in the dashboard at least 15 days before they apply. Continuing to use QRwik after that means you accept the new terms.
